Certain newly developed food zones in Udaipur city have not been taken lightly by public for obvious reasons of pollution and peace and relevance of those areas. Food court Khau Gali was being opposed by the residents of Sukhadia Circle area as it was causing too much of traffic jam issues and even pollution.

Reportedly, the owner of Khau Gali gave reasons for continuing with the food court. The request of the owner Siddharth Agrawal for not obstructing with the operation of the food court has been rejected by the court. Agrawal in his letter mentioned that he has 2 plots in New Fatehpura near Sukhadia Circle. The old buildings at these plots were demolished and since these plots are near the city’s happening spot Sukhadia Circle which is frequented by tourists, a number of eat-out centres like restaurants hotels, cafeterias and small scale industries like handicraft showrooms operate in this locality. He also mentioned that he obtained approval from Municipal Corporation and opened the restaurant which also provides employment to many people. Commercial tariff is being paid for this purpose since it is located in commercial area of the city. Electricity connection has also been taken from the Electricity board. For the facility of the tourists, cabins have been made for shelter. He even applied for conversion of land on 16th January 2019, which has not yet been approved. Agrawal said that he is even willing to pay property tax but he is not getting support from the relevant employees of Municipal Corporation.

Based on all these points, the appellant asked for permission for free operation of the food zone. Opposing this appeal, the lawyer of Municipal Corporation said that the food zone is being run in residential premises which cannot be used commercially without prior conversion and approval of tourism department. The Court henceforth rejected Agrawal’s appeal for the operation of Khau Gali. Municipal Corporation is now free to take action Khau Gali.
