Rajasthan High Court's big decision in the case of B.D.S colleges of the state
Rs 50 lakh fine for each college who has given admissions to students with less percentile
The Rajasthan High Court has rejected the appeals filed in the case of wrongful and illegal admissions given in B.D.S colleges. These colleges have given admissions to the students below the State government’s percentile criteria. The colleges have to pay a fine of Rs. 50 lakh each to the Rajasthan High Court in two months. The bench of Justice Dr. Pushpendra Singh Bhati and Justice Yogendra Kumar Purohit ruled their orders.
The students with whom the colleges have done wrong will be given Rs. 25 lakh from the college in three months. After the hearing, the High Court had reserved its decision on April 26. In this regard, the court gave its verdict on Thursday May 5, 2023.
All of these B.D.S students who have been given a degree by the college after giving admission on less percentile than the given relaxation given by the state government will be deposited back to the college. Senior advocates Ravi Bhansali and Rohin Bhansali, appearing for the Dental Council of India, said that for the first time in the state, 50 percentile was fixed for admission in B.D.S colleges through NEET exam.
The state government had given exemption to the colleges of 10 percentile first and later 5 percentile, reducing it to 50 percentile of NEET at its level. Some B.D.S colleges of the state have given admission below the minimum 35 percentile, which is wrong and illegal.
The Single Bench of the High Court, in its decision given on 20 April 2018, accepted the exemption given by the state government and allowed those students to pursue regular studies, but ordered the cancellation of admission of students with less percentile. Against this, the students had presented appeals for not canceling the admission and Dental Council Of India DCI against the 15 percentile relaxation of the state government.
