High Court: Scores in Govt Recruitment Process Not Private
Information can be obtained through RTI; is not an invasion of privacy, says Bombay High Court
November 12 - In an important decision regarding youth, the Bombay High Court said yesterday that disclosing candidates' scores in government recruitment processes does not infringe on their privacy or confidentiality. This information can be obtained through the Right to Information (RTI) Act.
The bench of Justice Mahesh Sonak and Justice Jitendra Jain issued this ruling while overturning an order by the Maharashtra State Commission, which had refused to provide these scores, citing them as private information.
The bench, in its judgment, emphasised that such public processes should be transparent and fair. In such selection procedures, the scores obtained by candidates cannot be considered personal information unrelated to any public activity or interest. Providing this information would not constitute an unreasonable invasion of privacy.
Section 8(1)(j) of the RTI Act only exempts the disclosure of personal information that has no relevance to any public activity or interest.
