Bajaj Allianz General Insurance company was today instructed by the court to pay the claim along with a penalty of Rs 10,000 for not honoring a mobile loss claim on time and unduly delaying the litigation.
Deepak Sahu and Mayank Sahu, residents of Bhoiwada, Badi Holi, Udaipur, had initiated an insurance claim on Bajaj Allianz General Insurance towards the loss of their mobile phone. As per the litigation filed by Deepak and Mayank, the mobile, which had been bought for Rs 32,000, was insured in March 2016 for a period of one year, by paying a premium of Rs 2,510/-. The insurance was valid till March 2017. In February 2017, the mobile was stolen and Deepak filed an FIR at the Sukher Police Station.
The company, Bajaj, refused to honor the claim citing a technical fault, that the mobile at the time of loss of equipment, was being used by Deepak’s brother. The court refused to take this excuse into consideration and said that this unwarranted technical reason was being used to unduly delay the litigation. The case was made against the Manager of Bajaj Allianz at its HQ in Yerwada Pune and the manager its office at Panchwati, Udaipur.
Bench, comprising of KB Katta, Sushil Kothari and Brijendra Seth in their decision said that the mobile phone was lost and the defendants were not honoring the claim by using unwarranted excuses which were not acceptable in the court of law.
The insurance company was instructed to settle Rs 24,000 plus a 10% interest on the claim amount along with a penalty of Rs 5,000 for causing mental and physical agony to the litigant.
