Court Rejects Bohra Youth’s Plea, says Dargah Renovation is Legal

Collector and District Magistrate Hemat Kumar Gera has straightly rejected the petition of the Dawoodi Bohra Jamat (Bohra Youth) saying that the construction work at the Dargah premises is which is going on under the NOC of the Muslim Waqf Board is illegal.
The petition applied by Yousuf RG who said that 400 year old religious shrine (Dargah) is not a property of any private organization or individual and they (Shia Dawoodi Bohra Jamaat) are doing construction work illegally and violating Section 6 of the Rajasthan Religious Place Act 1954.
The filed petition was against the Dargah Management Committee including Shiekh Shumail and Saifuddin Bhalamwala.
According to the local media reports, the District Magistrate investigated the matter and ordered that for construction of any new religious place, permission is required but for any renovation work in an already established Religious Place no permission is required.
The work was already undergoing with the permission and NOC of the Muslim Waqf Board which was given on 19th December 2011 and there was no violation of the Section 6 of the Rajasthan Religious Place Act.
District Magistrate Court also said that this order will not disturb any of the already existing case or any case to be filed in future between the appellant and the respondent.
Yosuf RG (Secretary of Dowoodi Bohra Jamat, Bohra Youth): We will take the matter to R.A.A. (Revenue Appellant Authority) our demand is that no work should undergo without proper permission and authorization.
He added that the matter of opening of the Doors of the Dargah is not his personal victory but a result of the unwearied efforts dedicated to his community.
