A woman fell into a pot hole right outside her own house six months back. Court has held Municipal Corporation responsible for this.

Sushila w/o Bhagwati Lal Bordia fell into a pothole outside her house at night. Bhagwati Lal Bordia himself acted as Sushila’s lawyer in the court. Lawsuit was filed against Municipal Corporation in Lok Adalat. President KB Katta and Member Brijendra Seth declared Municipal Corporation responsible for this and ordered the corporation to pay 51 thousand rupees as treatment charges and 2 thousand rupees towards court fees to the complainant.

Municipal Corporation defended itself stating that the complainant were on scooter with head lights on. Even the street lights of that area were on. The pot hole in which the couple fell was made by their neighbour for repair work of water connection. This has not been stated by the complainant in their law suit, nor has the neighbour been made party.

The court defended the complainant saying that Corporation is responsible for taking care of all matters regarding public routes. It is also responsible for protecting public property. Similarly, Corporation is responsible for taking care of pot holes on road. It cannot shrug off its responsibilities by blaming it on public. Court declared that Corporation is equally responsible for the trouble faced by the complainant.

The incident dates back to 15th February 2017 when the couple were returning home at night on their scooter. They fell into the pot hole outside their house. Sushila succumbed to fracture in her knee. The expense incurred on treatment and physiotherapy was 51 thousand rupees.

Court had sent a notice to Municipal Corporation on this issue which was not responsibly dealt with. The court hence ordered to reimburse the complainant with the treatment charges and also the amount paid towards court fees.
