The petitioner, Shailendra, resident of Sector-7, had gone to Big Bazaar, Celebration Mall on 10-May-2017. He bought Mango Jam from the store. The MRP of Jam was Rs 39 and there was a Rs 20 discount mentioned on it. However, when he went to the billing counter, he was charged the non-discounted price.
Big Bazaar advocates argued that it is likely that the petitioner had purchased the product from some other store and was pushing the case against Big Bazaar for making money. They also argued that is possible that he purchased the product during scheme time and wanted to also take advantage after the scheme had ended. However, none of these arguments stood well with the Consumer forum bench.
After investigating the complaint, the Consumer Forum bench ordered Big Bazaar to pay back Rs 19 that was taken as additional charge, Rs 1500 for mental trouble caused to the petitioner and Rs 1500 as legal fees amounting to a total of Rs 3019.
