Court rejects Gogunda MLA petition for dismissal of FIR and stay on arrest

The Jodhpur Bench of the Rajasthan High Court has rejected the petition for dismissal of FIR filed by the accused MLA of Gogunda Assembly seat of Udaipur, as well as stay on his arrest.

The MLA, Pratap Bheel had submitted a petition to the court to dismiss the FIR filed against him in an alleged rape case. The court, after hearing the petition, as well taking into cognizance the report on the investigation by the CID Crime Branch (CB-CID), the bench rejected the petition.

This rejection will present additional obstacles for the MLA who has been charged with molesting a woman.

Case background

As per the FIR, the victim accused the MLA that after she had filed the molestation case, the MLA had misused his position and got her son kidnapped. Thereafter, he forced the victim to change her statement assuring her of her rightful settlement outside court. The FIR alleges that despite taking back the initial FIR, the MLA did not stick to his promise and now the victim has lodged another FIR, towards which the MLA filed a petition for rejection.

CB-CID is a special wing in a CID headed by the Additional Director General of Police (ADGP) and assisted by the Inspector General of Police (IGP). This branch investigates serious crimes including murder, riot, forgery, counterfeiting and cases entrusted to CB-CID by the state government or the High Court.
