30kg Gold: New Twist in the Banswara Bohra Community Case

Banswara Additional District and Sessions Court (ADJ Court) canceled the order of CJM Court

Banswara, February 28: The infamous gold scam that has been haunting the Dawoodi Bohra community in Banswara has taken an interesting turn after the ADJ (Additional District & Session Court) cancelled the orders of the subordinate (CJM) court. The ADJ Court has cancelled the 18 February order of the CJM court, wherein directions were given to hand over nearly 27kg of recovered gold to the petitioners.

What is the Case History?

14 months ago, in November 2023, a matter related to the  Bohra community run Karzan Hasna Trust in Banswara came to light. According to the complainant, over 30kg of gold deposited against loan in the trust had disappeated. On investigation and interrogation, the police recovered nearly 28kg of the said gold from different people. The  petitioners went to court, requesting that the gold be handed over to the petitioners. The CJM dismissed this petition on May 7, 2024. The petitioners filed their petition with the  ADJ Court, where the matter was pending hearing.

In the meantime, the CJM court, on February 18, 2025 ordered the police to hand over the recovered gold to the petitioners. It was this order the ADJ court subsequently quashed, citing it as an illegal,, unjustified and ineffective misuse of the courts powers.

The ADJ court has additionally directed the CJM court to inform the related police station to recover the confiscated gold within 5 days and hand over the report to the ADJ. It is noteworthy that 3 revised petitions were filed in this case with the ADJ court. After hearing all these petitions, Addl Session Judge Naveen Chaudhary issued the above order. The order also said that the  revisionist (petitioner) did not come to the court for the hearings and many facts have been hidden by him. The ADJ court has also instructed that a copy of the order be sent to the Registrar of the High Court and the Vigilance wing to bring it to the notice of the Rajasthan High Court in Jodhpur.
