High Court: RTE 25% Quota to Apply from Pre-Primary to Class 1
The Court declined to interfere in appeals related to issues such as fee reimbursement and other connected matters
Jan 9, 2026 - Rajasthan High Court has ruled that the 25% quota under the Right to Education (RTE) Act will be applicable at every admission level from pre-primary to Class 1 in private schools. The Court clarified that in cases of multi-level admissions, the 25% RTE quota in Class 1 will apply only to seats that are additional to those filled through pre-primary admissions.
The Court declined to interfere in appeals related to issues such as fee reimbursement and other connected matters.
The Division Bench comprising Acting Chief Justice Sanjeev Prakash Sharma and Justice Baljinder Singh Sandhu delivered the verdict on Thursday (January 8). The hearing in this matter was concluded on November 4, after which the judgment was reserved.
The Court dismissed the appeals filed by the State Government and others. However, while hearing the Public Interest Litigations (PILs) filed by Abhyutthanam Society and Smile for All Society, the Court said that guidelines would be issued.
The groups had challenged a 2020 notification issued by the State Government, which said that fee reimbursement to private schools would be provided only for admissions made in Class 1.
The groups argued that no fee reimbursement was being provided for admissions under RTE in pre-primary classes. They submitted that since many private schools have pre-primary classes, admissions are completed before Class 1, resulting in denial of RTE admissions at later stages.
On the other hand, private schools contended that they have limited resources and that no clear rules regarding fee reimbursement have been framed by the State Government since 2009. The State Government argued that if RTE admissions are made at both pre-primary and Class 1 levels, reimbursement for pre-primary admissions should also be obtained from the Central Government.
