Nov 5, 2025 - Under the Right to Education (RTE) Act, the Rajasthan High Court has completed the hearing on disputes related to entry-level admission and fee reimbursement in private schools. The verdict will be announced later.
A Division Bench comprising acting Chief Justice Sanjiv Prakash Sharma and Justice Baljinder Singh Sandhu on Tuesday, November 4, heard public interest litigations (PILs) filed by Abhyutthanam Society and Smile for All Society, along with more than 35 appeals filed by the State Government, private schools, parents and other affected parties.
The petitions claimed that several private schools admit students to pre-primary classes, owing to which children are denied RTE admissions at the entry level.
On the other hand, private schools argued that the previous order allowing RTE admissions at both pre-primary and first-grade levels was incorrect. The State Government, however, has not framed rules for fee reimbursement under RTE since 2009.
Additional Advocate General Surendra Singh Naruka, appearing for the State, said that while the Central Government provides funds to States for admissions in Grade 1, similar funds should also be sanctioned for pre-primary admissions. The Central Government has already clarified that the responsibility for implementing RTE admissions lies with the States.
