High Court on RTE: Pre-Primary Fees to be Reimbursed by Govt
High Court declines to interfere with the Single Bench’s order that placed responsibility on State Government to reimburse fees of RTE Pre-Primary students
Jan 15, 2026 - The Division Bench of the Rajasthan High Court has declined to interfere with the Single Bench’s order that placed responsibility on the State Government to reimburse fees of students admitted to pre-primary classes under the Right to Education (RTE) Act. As a result, the State Government will now have to reimburse the fees of students admitted to pre-primary classes under RTE as well.
The Division Bench also dismissed the State Government’s appeals related to this matter along with other connected appeals.
The verdict was delivered by the Division Bench comprising Acting Chief Justice Sanjeev Prakash Sharma and Justice Baljinder Singh Sandhu.
Earlier, in July 2023, the Single Bench of the High Court had challenged a 2020 State Government notification that limited reimbursement to Class 1 and directed that admissions be granted under RTE in private schools at both Nursery and Class 1 levels, and that the government pay the applicable fees.
