Radisson Blu Appeal Rejected by High Court Bench

Radisson Blu Appeal Rejected by High Court Bench

Chief Justice Sunil Ambwani and Justice Jayshree Thakkar of the Rajasthan High Court Bench quashed the appeal of Radisson Blu, a premier Hotel Property in Udaipur, near the banks of Lake Fatehsagar.

The property, earlier managed under Sheraton, Rockwood, Hilton Granite, etc. is now being managed under the Radisson Blu brand, and over the last 4 years has been asked to demolish the construction, cited as illegal.

A leading local daily had, in 2011 exposed the illegal encroachment of the property on both private and government land, situated near Lake Fatehsagar. Taking action on the news reported by this daily, the District Administration and UIT had completed their due diligence and given notices to the owners, instructing them to dismantle the building and the other construction in the area.

In response, the then Hotel Management had given three appeals to the appellate authority, and taken the case to the High Court bench.

Accordingly, after hearing all sides of the argument, the High Court bench, on Tuesday, gave orders to adhere to the instructions of the local administrative authorities, thereby dismissing the appeal of the Hotel.  A copy of the orders passed by the High Court bench has been dispatched to UIT, Udaipur.

As per the notices given by UIT earlier, encroachment of government land, disallowed construction in private land and construction in lake conservation areas were the three clauses under which the UIT had instructed demolishing the construction.

Advocate Dilip Kavadiya, representing the UIT claimed that the hotel had encroached on government land under the cover of the approved map and had appealed to regularize the encroachment, which should not be accepted.  He also said that earlier, a State Government committee had conducted a spot check and concluded that a major part of the hotel construction was on encroached land.

A writ had also been filed earlier in the Supreme Court by the Hotel Management, which was taken back after the UIT and District Administration presented factual reports proving that the Hotel had completed major construction on encroached land and also in the No Construction zone.
