Rajasthan High Court: Don’t pollute Lake; Else face criminal prosecution
Rajasthan High Court (HC) has ordered Udaipur administration including Udaipur Municipal Council and Urban Improvement Trust (UIT) to take strict action against those who are directly or indirectly causing threat to the Lakes of Udaipur, known to be the lifeline of the city.
· Dismantle all constructions raised without legal permission.
· Demolish Vardha Hotel Construction at Udaisagar Lake.
· Additional construction of Singhal’s house to be demolished.
· Plastic ban at Fateh Sagar and Pichhola.
· Constitute Lake Development Authority.
Rajasthan High Court (HC) has ordered Udaipur administration including Udaipur Municipal Council and Urban Improvement Trust (UIT) to take strict action against those who are directly or indirectly causing threat to the Lakes of Udaipur, known to be the lifeline of the city.
The order of court came on 27 September 2012 after the petition filed by an Udaipur citizen, Rajendra Razdan.
In its 132 pages order, High Court has mentioned several points and its related aspects. Mainly, the illegal constructions (commercial and residential) developed in “No Construction Zone”, nearby Lake Fateh Sagar, Lake Pichhola and Lake Udaisagar.
The court has also ordered to relocate the marble slurry dumping yard to an unobjectionable place. HC has asked Udaipur administration to take immediate legal action against the offenders.
According to the court, the under construction luxury hotel by Vardha Enterprises at an Island of Lake Udaisagar should be demolished completely within 2 months.
30 additional rooms, constructed by Lake Palace Hotels & Motel Pvt. Ltd should be demolished within one month from the date the orders have been issued.
Court has ordered Chief Secretary, Divisional Commissioner, Collector, Rajasthan State Pollution Control Board, Secretary UIT and Commissioner Municipal Council to ensure no waste (solid or liquid) coming out from residences, factories or any premises immerses into Ayad River or the Lakes. Criminal prosecution might be charged against the offenders, though the concerned persons are advised to install septic tanks.
It is also been ordered to accomplish the work of STP (Sewerage Treatment Plant) within three months from the date orders have been passed.
Court has also ordered to demolish the additional construction at the bungalow owned by Singhals near Lake Swaroop Sagar within 2 months.
Breed “Grass Carp” fish to balance Lake Environment
High court has asked UIT and Municipal council to breed fishes like grass carp, which consumes filth in lakes to help maintaining the natural habitat of lake water.
Plastic Free Zone near Lake
No products could be sold in plastic bags or plastic packaging near Bambaiya Bazaar; all items should be sold in biodegradable or reusable packaging.
Remove Marble Slurry Dumping Yard
The existing marble slurry dumping yard at Chitrakut Nagar should be relocated at any other preferable and unobjectionable place.
Vardha Enterprises Hotel is illegally constructed
In addition of slapping fine amount of Rs. 1 Crore for illegally constructing road, boundary wall and structure of hotel at the island of Lake Udaisagar that is affecting environment and ecology, court has asked the hotelier to demolish the whole construction within the given period of time.
UIT to submit proposal of, how it can ensure the natural rain water coming through the canals is not disturbed by the work of Highway Authority of India.
All administrative officials have stated that they are all prepared to follow the orders of high court.
