Assam Passes Bill to Ban Polygamy in State

Chief Minister Himanta Biswa Sarma signals commitment to implementing Uniform Civil Code if re-elected

Nov 28, 2025 - The Assam Legislative Assembly on Thursday passed the Assam Prohibition of Polygamy Bill, 2025, imposing a ban on polygamy in the State. Under this Bill, polygamy will be considered a cognizable criminal offence in the State.

According to the provisions, a person found entering into a second marriage without legally dissolving the first can face up to seven years of imprisonment and a fine. If a person conceals an existing marriage and enters into a second marriage, the punishment may extend to 10 years in jail along with a fine. The Bill also provides a compensation for the victim.

People belonging to Scheduled Tribes (ST) and areas under the Sixth Schedule of the Constitution, which grants autonomy to tribal regions in north-eastern States, have been excluded from the purview of this law.

However, if a person conceals their existing marriage and marries again, they may face 10 years of imprisonment along with a fine. The Bill proposed double the prescribed punishment for repeat offenders.

Anyone knowingly participating in polygamy, such as a village head, qazi, parent/guardian, will face up to two years of imprisonment and a fine of up to Rs 1 lakh. A jail term of two years or a fine of up to Rs 1.5 lakh would be given to any person who knowingly sermonises such a marriage.

The proposed legislation was placed before the 126-member House on November 25.

Additionally, Chief Minister Himanta Biswa Sarma said that if he becomes Chief Minister again after the next year’s Assembly elections, a Uniform Civil Code (UCC) will be implemented in the State. He also mentioned that a separate Bill will be introduced during the session by the end of February to address marriages conducted through fraud.
