A bank has been penalised by the Consumer Court for dishonouring a cheque on wrong grounds of insufficient funds. The account holder Ravindra Kumar approached Consumer Court in this case as his account in Marudhara bank has sufficient funds but the bank’s negligence caused him mental harassment.

As reported by Ravindra, Proprietor of Power Food caterers, he made certain payment to Deepika Trading Company in December 2016 by means of cheque. This company has its account with HDFC Bank. The cheque was dishonoured on account of insufficient funds as stated by HDFC Bank though there was sufficient amount in his account. He was even levied cheque bounce charges of 150 rupees. Marudhara Bank in its clarification statement said that the cheque got bounced due to technical faults.

Consumer Court was approached in this case who stated that Marudhara Bank was solely responsible for this error and HDFC Bank could not be held responsible as there is no direct connection between HDFC Bank and the consumer. The cheque got bounced due to the negligence of Marudhara Bank, hence Marudhara Bank has been penalised with 2150 rupees which includes court fees, payment against mental harassment and bank charges.
