2 G Scam Verdict, a shot in arm for Congress?
Charge sheets filed by Enforcement Directorate and CBI were mainly on verbal statements. Any verbal statement given by a witness is always required to be substantiated by other material and corroborative evidence and in absence of corroborative evidence the verbal statement would hold no water, especially, in criminal cases, where slightest iota of doubts would go in favour of the accused
A day of delight for Congress and DMK as the special CBI Court of New Delhi acquitted all accused in the much debated 2G scam case. The news is great stress reliever for two parties including the old and infirm patriarch of DMK K Karunanidhi since his daughter Kanimozny was prime accused along with A Raja and both have since been acquitted.
2 G scam has been much debated scam and one of the reasons of downfall of congress party and its credibility. Having proved its innocence, the decision of trial court is a shot in arm for Congress, who claims that the party is on revival and comeback path.
Charge sheets filed by Enforcement Directorate and CBI were mainly on verbal statements. Any verbal statement given by a witness is always required to be substantiated by other material and corroborative evidence and in absence of corroborative evidence the verbal statement would hold no water, especially, in criminal cases, where slightest iota of doubts would go in favour of the accused.
The court observed that no case can be substantiated by merely gossips and rumors. The CBI probe has been lackluster followed by poor prosecution, which resulted into the failure of the case. It may be re-called that 2 G scam case has maligned the image of UPA government in which DMK was an ally and DMK’s A Raja was holding ministry of telecom.
The court observed that no link could be established between role of A Raja and transfer of 200 crore of rupees from Dynamix Balwas group to Kalaignar TV, which was claimed to be amount of gratification. The option to go for appeal before High Court is open for the two prosecution agencies.
