The case involved a murder accused, whose bail application was filed in December 2024 but was repeatedly adjourned over 25 months before reaching the bench. Justice Kathpalia noted that such delays are unacceptable, stating that liberty cannot be kept in limbo for so long, and emphasized that judicial vacancies and systemic delays are key reasons for this backlog.

Case Details:

  • The plaintiff was involved in an incident where one person was killed, and another was injured. The accused allegedly restrained the latter while another accused stabbed him.

  • The plaintiff had been in custody since October 2021. The prosecution admitted that all witnesses had already testified, so there was no risk of tampering if the accused plaintiff were released on bail.

  • The defense argued the incident happened in the spur of the moment and that the injured victim's testimony did not fully support the prosecution’s case.

Court Observations:

  • Justice Kathpalia stressed that bail applications should not remain pending for long periods, as it causes unnecessary trauma and violates fundamental rights.

  • Even though the nature of the offense was serious, the court prioritized the accused’s right to liberty, especially given the prolonged delay.

Decision:

  • The accused plaintiff in the bail application was granted bail on furnishing a personal bond of Rs. 10,000 with one surety of the same amount.

  • The order instructed that the Jail Superintendent be immediately informed of the release.

The judgment serves as a reminder to the government and judiciary to address delays in bail cases promptly, fill judicial vacancies urgently, and ensure the rights of the accused are not compromised.
