Under the current Trump administration, marriage-based Green Card applications are facing close scrutiny, says immigration attorney Brad Bernstein of Spar & Bernstein. Authorities will now also verify whether the husband and wife actually live together after marriage. This responsibility has been assigned to the US Citizenship and Immigration Services (USCIS).

The US administration, led by President Donald Trump, is clamping down on Green Card applicants and tightened the rules. According to Bernstein, having a marital relationship alone is not sufficient for a Green Card; living together and sharing a family life is essential. If a couple is found to be living separately, the application can be directly rejected.

This stricter policy serves as a warning to those who viewed marriage as an easy route to obtaining a Green Card with several cases of fake marriages surfacing in the past in attempts to secure Green Cards.
