School has right to charge fee for Air Conditioning: Delhi High Court

Delhi High Court Order Parents need to bear the Cost of Air Conditioning in School Classrooms

In its order, the Delhi High Court on May 2 dismissed a petition that challenged a school's right to charge for Air Conditioning. The Court said that charging for Air Conditioning is similar to charging for Laboratory or for Smart Classes.

The petitioner argued that the Rs 2,000 per month fee being charged by the school as Air Conditioning Fee was unreasonable. The petitioner also asked for the intervention of the Directorate of Education and said that the obligation to provide airconditioning in classrooms was on the management of the school and should be paid from the school's fund.

"Cost of providing Air Conditioning services in school must be borne by the parents", said the order of the two Judge bench of Acting CJ Manmohan and Justice Manmeet PS Arora of the Delhi High Court. Adding that there seemed to be no irregularity in the charge levied by the school the order said that the "financial burden of providing such facilities cannot be rested on the school management alone and that parents must also be mindful of the facilities and the cost of the facilities provided to their children while choosing a school."
