The  Protection of Children from Sexual Offences Court No. 2 (POCSO) of the District and Sessions Court, Udaipur has awarded death sentence to a minor rape accused. The court also awarded a 4 year imprisonment to the  parents of the accused. The sentence for the has been suspended  for a period of 60 days, during which they will be out on bail and can appeal in High Court against their sentence. Kamlesh Singh, is however under police custody since his crime is unbailable. 

Judge Sanjay Bhatnagar read out the decision after hearing 42 witnesses from the prosecution side and examining more than 172 documents exhibited in the matter.

Public Prosecutor Sayed Hussain said that the incident took place on March 29, 2023 at a village in Mavli, Udaipur. The accused Kamlesh lured the girl, took her to his house located near her house, raped and killed her brutally. With an intent to hide the evidence, Kamlesh, along with his parents chopped her dead body into 10 pieces and dumped it in an isolated house located few meters away from his house.

The chopped body was recovered from the house on April 1, 2023. The accused was arrested after four days of the incident and since then he and his parents were under judicial custody and the matter was under trial.

The Public Prosecutor further  informed that "It is a major decision and a big day for the people of Mewar who are seeking justice for the victim and her family members. The Court had considered it to be a brutal and inhuman incident, and considering it to be a rare case awarded the accused with capital punishment".

The parents of the accused were booked under Section 201 IPC for hiding or destroying evidence of the crime. The accused Kamlesh meanwhile, was found guilty under Section 6 POCSO Act, Section 302 of IPC for Murder, 376 (ab) Rape, Section 363 IPC for Kidnapping, Section 366, 342 and 4/25 of Arms Act.
