Rajasthan High Court Gives Big Relief to MLSU Professor, Stays Termination Order

Udaipur, May 28, 2026: Rajasthan High Court Order In a significant development, the Rajasthan High Court has provided temporary relief to Professor Mahendra Singh Dhaka of the Physics Department at Mohanlal Sukhadia University (MLSU), Udaipur. The court has put an interim stay on the university’s order terminating his services.

A single bench of Justice Kuldeep Mathur issued notices to both the university and the Rajasthan government, asking them to respond to the matter.

Court Questions MLSU’s Action

During the initial hearing, the High Court observed that removing a permanent employee without a proper departmental inquiry appears unfair at first glance. The court noted that due process must be followed, especially in cases involving permanent staff members.

As a result, the implementation of the university’s termination order has been temporarily halted.

What Is the Case About?

MLSU had terminated Professor Mahendra Singh Dhaka’s services on December 23, 2025. The action came after an inquiry into alleged irregularities in recruitments made in 2010.

Professor Dhaka was appointed as an Associate Professor in 2012 under the OBC category. Later, in 2015, he received a promotion under the Career Advancement Scheme.

However, in 2022, an inquiry committee formed under the directions of the Governor and Chancellor reportedly found irregularities in his appointment process. The report claimed there were violations in recruitment rules and also raised concerns over the validity of his OBC certificate.

Based on the committee’s findings, MLSU’s Board of Management decided to lodge an FIR against him and terminate his services. Following this, the university registrar issued the dismissal order in December 2025.

Professor Dhaka Argued His Own Case

Professor Mahendra Singh Dhaka personally represented himself in the High Court. He argued that he is a permanent employee of the university and, according to Statute-73 of MLSU, no permanent employee can be removed without a proper disciplinary inquiry.

He told the court that no such inquiry had taken place in his case.

Notice to MLSU and State Government

Until the next hearing, the High Court’s interim order has brought relief to Professor Dhaka. Meanwhile, MLSU and the Rajasthan government have been directed to submit their responses before the court.
