The US Supreme Court had rejected an emergency application by 26/11 Mumbai terror attacks accused Tahawwur Rana to stay his extradition to India
March 7, 2025 – Tahawwur Rana has submitted a renewed application to Chief Justice John Roberts seeking to halt his extradition to India. Rana filed an "Emergency Application for Stay Pending Litigation of Petition for Writ of Habeas Corpus" with requests that the renewed application be directed to CJ Roberts
This was following the rejection by the US Supreme Court of the emergency plea filed by Rana to stay his extradition to India. Rana had filed an “Emergency Application for Stay” motion with Associate Justice Elena Kagan on the plea that were he extradited to India, he would be tortured during his trial and his chances of survival would be less as he was a Pakistani-origin Muslim.
The petition filed on his behalf said that “If a stay is not entered, there will be no review at all, and the US Courts will lose jurisdiction, and the petitioner will soon be dead.”
The 64-year-old Rana is a Canadian national of Pakistan origin and is wanted by the Indian authorities for his alleged involvement in the 2008 Mumbai terror attacks which killed 166 people.
The US Supreme Court had in January 2025 cleared the extradition of Rana to India after denying the “petition for a writ of certiorari” filed by the 26/11 attack accused who is currently lodged at the Metropolitan Detention Centre in Los Angeles.
