By a law passed by the parliament e-cigarettes are classified as tobacco products.

Raids were carried out in some shops after getting information about the supplies of e-cigarette. Search and seizure operation was done under Cigarette and Tobacco Act, 2003 and Drug and Cosmetic Act.

Chief Medical and Health Officer (CMHO) along with Drug Control Officer went to raid a shop in Panchwati but reportedly this shop is closed since past 2 years. The team even raided several other shops regarding e-cigarettes. Some challans were issued under COTPA Act Section 4 and 6.

Section 4 says that “No person shall smoke in any public place: Provided that in a hotel having thirty rooms or a restaurant having seating capacity of thirty persons or more and in the airports, a separate provision for smoking area or space may be made.”Section (4) of the COTPA 2003 prohibits smoking in all public places.

Section 6 says No person shall sell, offer for sale, or permit sale of, cigarette or any other tobacco product- (a) to any person who is under eighteen years of age, and (b) in an area within a radius of one hundred yards of any educational institution.
