Supreme Court Flags Use of AI in Court Filings by Lawyers

Supreme Court raises concern over lawyers using AI to draft petitions without verification after fictitious judgements were cited in Court filings

Feb 17, 2026 - The Supreme Court of India on Tuesday (February 17) expressed serious concern over the growing use of artificial intelligence (AI) in preparing petitions filed before the Court. This issue was flagged following several submission of petitions before Courts that relied on judgement and quotations that were either factually incorrect or fictitious.

A Bench comprising Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and BV Nagarathna noted that petitions prepared using AI tools without proper verification are increasingly being filed before the Court.

“We have been alarmingly told that some lawyers have started using AI for drafting,” CJI Kant said adding that it was done without properly verifying the facts.

The Court observed that in several cases, lawyers cited judgments and references that either did not exist or were found to be incorrect.

“There was a case of Mercy vs Mankind which does not exist,” said Justice BV Nagarathna of a case in which a judgement was cited that did not exist at all and flagged the risks of relying blindly on automated tools.

Another such incident was pointed out by CJI Kant where “not one, (but a) series of such judgements were cited” in Justice Dipankar Datta’s Court.

The judges remarked that while AI can assist in research, the final responsibility always lies with lawyers and judges.
