The Udaipur Development Authority Bill is poised to play a pivotal role in the growth and development of the city of Udaipur. It outlines a comprehensive plan for urban development and infrastructure enhancement in the region.

What is the Udaipur Development Authority Bill

The city of Udaipur is expanding beyonds its earlier boundaries and the upcountry areas are gradually becoming developed and populated and there is a strong need to name such areas as Udaipur Region. There is thus a strong need to provide housing, community facilities, civic amenities and other infrastructure  for the resident population for which there is a need to design plans, coordinate and supervise them for proper, systematic and systematic development of these areas. To facilitate the development of these areas that will come under the purview of the Udaipur Region, a Bill titled the Udaipur Development Authority Bill was proposed in the Rajasthan Assembly, which gives the green signal for the creation of the Udaipur Development Authority, which will be the administrative body to oversee the development of the newly approved Udaipur region.

Udaipur Development Authority (UDA) shall be established immediately on the commencement of this Act, by notification in the Official Gazette.

The Udaipur Development Authority shall be a body corporate with perpetual succession and a common seal and shall be governed by and construed in accordance with the provisions of this Act. Under the definitions provided by the Rajasthan General Clauses Act 1955 the Udaipur Development Authority will fall under the definition of a "Local Authority". The UDA will have the right to acquire, hold and dispose of property, both movable and immovable, and to enter into contracts and will be able to bring a suit in its own registered name, while a suit can be brought against the UDA as well.

As per the contents of the UDA Bill, the UDA will consist of the following members:

  1. Chairperson, who shall be appointed by the State Government;
  2. Udaipur Development Commissioner, who shall also function as the Deputy Chairman;
  3. Chief Secrertary of the Urban Development and Housing Department of the Govt of Rajasthan or his representative  who shall not be below the rank of Joint Secretary;
  4. Deputy Housing Commissioner, Rajasthan Housing Board, Jaipur Udaipur Division;
  5. Additional Chief Engineer, Public Health Engineering Department, Udaipur;
  6. Additional Chief Engineer, Public Works Department, Udaipur;
  7. District Collector, Udaipur;
  8. Chief Managing Director, Ajmer Food Distribution Corporation Limited, Ajmer;
  9. Mayor/Administrator, Municipal Corporation, Udaipur;
  10. District Head, District Councilor, Udaipur;
  11. Senior City Planner, Udaipur;
  12. not more than seven non-government members to be nominated by the State Government; and
  13. Secretary, Udaipur Development Authority – who will be the Member-Secretary.

In addition to the above mentioned members, the State Government may, if it thinks fit, also appoint the Chairman of any Executive Board as a member of the Authority. The regular clauses of conflict of interest will apply to these members.

  1. The Udaipur Development Authority shall also have an Executive Committee, which will consist of:
  2. Udaipur Development Commissioner, who shall be the Chairman;
  3. A representative of the Secretary, Urban Governance (Development and Housing), who is not below the rank of Deputy Secretary;
  4. The Secretary, Udaipur Development Authority, who shall be the Member-Secretary of the Committee;
  5. Asst Chief Engineer, Public Works Department, Udaipur Division, Udaipur, Rajasthan;
  6. Chief Engineer, Public Health Engineering Department, Udaipur District, Udaipur, Rajasthan;
  7. Managing Director, Ajmer Water Distribution Corporation Limited or its representative who is not below the rank of Chief Engineer;
  8. Managing Director, Rajasthan State Industrial Development and Planning Corporation Limited or his representative not below the rank of General Manager;
  9. Managing Director, Rajasthan State Road Transport Corporation or his representative not below the rank of General Manager;
  10. Deputy Director, Tourism, Udaipur;
  11. Director, Engineer of the Authority;
  12. Director, Town Planning of the Authority;
  13. Director, Finance of the Authority;
  14. Director, Law of the Authority;
  15. District Collector, Udaipur;
  16. Superintendent of Police, Udaipur; And
  17. Commissioner, Municipal Corporation, Udaipur;

The Executive Committee shall exercise the following powers and perform the following duties, viz:

  • Organization of divisions and functional units of the Authority;
  • Preparing draft regulations and recommending their making to the Authority;
  • Operation of Udaipur Tourism Development Corporation;
  • Preparation of projects and schemes;
  • Accepting or rejecting tenders for projects and schemes;
  • To create posts under the Authority at such level as may be determined by regulation with the prior approval of the Government;
  • Borrowing and re-borrowing of funds as required by the authority;
  • Planning of surplus funds of Udaipur Urban Development Centre;
  • The giving of, or any share in the expenses of, grants, financial assistance, loans or advances to any local or other authority or person for projects and schemes;
  • Instituting or withdrawing legal proceedings of the Authority; and
  • To delegate powers or functions to any person under their jurisdiction or authority.

The UDA Bill also proposes the creation of the Udaipur Traffic Control Board, Transport and Communication Board, Water Resources Management Board and Housing, Urban Renewal and Environment Board under the Udaipur Development Authority.

The main objective of the Authority will be to achieve integrated development of Udaipur region viz.

  • Preparation of master development plan and zonal development plans.
  • Making projects for the development of Udaipur region or any part thereof and approving them.
  • Executing projects and schemes directly or getting them done by a local authority or any other agency;
  • To make recommendations to the State Government regarding any such matter or any proposal for the overall development of Udaipur Region.
  • To partner with any other authority for the development of Udaipur region;
  • To coordinate the execution of projects and schemes for the development of Udaipur Region;
  • Preparation of scheme and agriculture, horticulture, fruit farming, forestry, dairy development, transportation, communication, opening of schools, cultural activities and coordinating between departments regarding preparation and implementation of schemes for expansion of sports, tourism, entertainment and other such activities and providing advice to agencies;
  • To execute projects and schemes as per the instructions of the State Government;
  • Undertaking residential work in Udaipur Region:
  • To prepare master plans for traffic control and management, to formulate policies and programs of action for traffic facilitation and matters connected therewith;
  • Urban renewal, environment and ecology, transport and communication and management of water resources are undertaken directly by the State Government or by other departments/agencies;
  • Provision for erection of signs, traffic signs, road signs and name boards in any part thereof as may be prescribed by the Udaipur Municipal Corporation or the Authority.;
  • Construction or re-construction of a building or an excavated part of a building in Udaipur City or any part thereof and the elements to be constructed therein as may be prescribed by the Authority.
  • To regulate the work of alteration, and management of open spaces;
  • Removal of encroachments and obstructions from public roads, open spaces and property owned by the Government or authority;
  • To do such other acts and things as are necessary or incidental or conducive to the matters arising out of its activities and which are necessary for the attainment of those objects It is necessary to fulfill the functions for which the authority has been established;
  • To do such other acts as may be prescribed by the State Government for carrying out the purposes of this Act.

Dissolution of the  Urban Improvement Trust

  • the urban area of Udaipur shall cease to vest in the Urban Improvement Trust, Udaipur (UIT), and UIT shall cease to exercise jurisdiction or the function in that area;
  • UIT functioning in the area covered by the urban area of Udaipur, immediately before such constitution, shall stand dissolved;
  • all land, buildings and other immovable properties situated in urban area of Udaipur and vested in the UIT for the purpose of carrying out or undertaking development or improvement in such area, immediately before such constitution, shall pass on to and vest in the Authority so constituted;
  • all stores, articles or other movable properties belonging to the Trust held by it for the purpose of carrying out or undertaking development or improvement in such area, immediately before such constitution, shall pass on to and vest in the Authority so established;
  • all assessments, valuations, measurements or divisions made by the Trust immediately before such constitution in or in connection with such area, shall, in so far as they are not inconsistent with the provisions of this Act, continue and be deemed to have been made under the provisions of this Act unless and until they are superseded by any assessment, valuation, measurement or division made by the Authority;
  • all plans, schemes for the development or improvement of any area declared as the urban area of Udaipur and prepared under the said Act, shall in so far as they are not inconsistent with the provisions of this Act, be deemed to have been prepared under this Act and any such plan or scheme which was in force immediately before the commencement of this Act, shall continue to be in force so long it is not otherwise dealt with under this Act;
  • all records and papers belonging to the Trust and relating to the development or improvement of such area, including the plans and schemes and papers relating thereto, as are referred to above shall vest in and stand transferred to the Authority;

Services of UIT Personnel

Every officer or servant serving under the Trust immediately before such constitution shall, on or from such constitution, be deemed to have been transferred temporarily for a period of six months to the Authority within which period until otherwise extended by it, the Authority shall, after their screening in such manner as may be determined by regulations, absorb them in the service of the Authority on such posts and with such designations, as the Authority may determine.

The Officer and servants so absorbed in the service of the Authority may hold office by the same tenure, at the same remuneration and on the same terms and conditions of service as they would have held if the Authority had not been constituted, and shall continue to so hold unless and until such tenure, remuneration and terms and conditions are duly altered by the Authority. Such of the officers and servants who are not absorbed by the Authority under its service shall be deemed to be surplus officers and servants of the Trust and shall be absorbed by the State Government in the service of any local authority or other authority as the State Government may deem fit, on such posts, with such designations on such salary and allowances and on such terms and conditions of service as may be prescribed but they shall not be absorbed on posts on terms, which are less advantageous to them in the matter of salary and allowances, provided that:

  • any service rendered by any officer or servant so absorbed before such constitution shall be deemed to be service rendered under the Authority; and
  • the surplus officers and servants not so absorbed shall be continued in the service of the Authority and their salary and allowances shall be paid out of the Funds of the Authority until they are absorbed by the State Government
  • notwithstanding anything contained in this Act, the validity of any declaration of application, publication, notification, appointment, order, allotment of land, proposal, award, proceeding, consultation, inquiry, certification, compromise, sanction, agreement, notice, approval, decision, dispute, withdrawal of any legal proceeding, final scheme or Act made, held, issued entered into, given, taken, decided, drawn up, or done, before such constitution, by or on behalf of the Trust, shall be deemed as if they were made, held, issued, entered into, given, taken, decided, drawn up or done under this Act by or on behalf of the Authority;
  • all compromises, defence or withdrawals, made in or from any legal proceeding, any offence compounded or any claim admitted, by or on behalf of the Trust before such Constitution shall be deemed to have made by or on behalf of the Authority and may be enforced by or against the Authority as effectively as they could be enforced by or against the Trust before such constitution;
  • all suits, prosecutions and other legal proceedings instituted by, for, or against the Trust may be continued or instituted by, for, or against the Authority;
  • all properties movable and immovable and all rights, title and interest in any property vested in the Trust shall vest in the Authority and all such properties in possession of the Trust shall be deemed to be in possession of the Authority;
  • all rents, fees and other sums of money due to the Trust shall be deemed to be due to the Authority; and
  • all sums or charges which the Trust was, immediately before such constitution, entitled to levy, assess and recover for or in respect of development or improvement of any land in the urban area of Udaipur, may continue to be levied, assessed and recovered by the Authority under the corresponding provisions of this Act.
