Waqf (Amendment) Act: SC to Hear Petitions on April 16

Rajasthan government files application in Supreme Court to include it as a party in the petitions filed against the Waqf (Amendment) Act, 2025

Udaipur, April 14, 2025 - Following intense political debates both inside and outside Parliament, preparations are now underway to intensify the legal battle over the Waqf (Amendment) Act, 2025 in the Supreme Court (SC). These petitions are scheduled for hearing on April 16. The case is listed before a Bench headed by Chief Justice of India Sanjiv Khanna. Meanwhile, the Centre has already filed a caveat in SC to ensure that no order is passed without hearing it first.

The Rajasthan government has approached the SC in support of the new law. The State government has filed an application requesting the Court to include it as a party in the petitions filed against the law. Through Additional Advocate General Shiv Mangal Sharma, the Rajasthan government has submitted a plea stating that there are a large number of Waqf properties in the state, and the State administration plays a significant role in their governance and regulation.

The application defends the Amendment Act as a transparent and constitutionally sound reform. It emphasises that the Act was passed after extensive consultations at the national level. Its objective is to curb the arbitrary practice of declaring government and private lands as Waqf properties. 

Several individuals, including Member of Parliament Asaduddin Owaisi, have filed petitions in the SC challenging the constitutional validity of the Waqf (Amendment) Act, 2025. The Communist Party of India filed a writ petition on April 9 in the SC challenging the Constitutional validity of the Act. Additionally, Tamilaga Vettri Kazhagam (TVK) president and actor Vijay has also filed a petition in the SC challenging the Act.

Others who have moved the country’s top Court against the Act include the All India Muslim Personal Law Board (AIMPLB),Congress MPs Mohammad Jawed and Imran Pratapgarhi, AAP MLA Amanatullah Khan, and Azad Samaj Party chief and MP Chandra Shekhar Azad.
