In a dictatorial verdict leading to the violation of fundamental rights of women, a Khaap Panchayat imposed restrictions on daughters asserting share in their parental property. The Panchayat also prohibited them from keeping relations out of the caste.
The Maha Panchayat of Suthar Samaj organized at Bijanwas village on Thursday passed a resolution prohibiting women from claiming property rights from their parents. If anyone found to do so, she will be outlawed for 10 years. The verdict affected 50,000 families under the caste panchayat where more than 1200 people participated in the meeting.
One of the society members Dalchand said, “This is unfair on the sons who are responsible to take care of the parents while the daughters are married off and hence free of liabilities.”
Senior counsel Arun Vyas said, “These decisions are unconstitutional and violation of the law. After the amendments of 2005 of the Hindu Successin Act, a daughter has equal rights like her brother on acquired and inherited property of her parents and she can’t be denied of her claim by a panchayat.”
On the other hand SP Rajendra Prasad Goyal said, “We will verify whether such a diktat has been passed by the Panchayat and if found true, stringent action would be taken.”
