Nitish Kumar Resigns as Bihar MLC; Set for Rajya Sabha

Bihar Chief Minister Nitish Kumar resigns from Bihar Legislative Council after being elected to Rajya Sabha; he is expected to take oath in April as political developments unfold

March 30, 2026 - Bihar Chief Minister Nitish Kumar resigned from the Bihar Legislative Council (MLC) on Monday, March 30, marking a major political development in the State. Kumar was recently elected to the Rajya Sabha (March 16) and is expected to take oath as a Rajya Sabha MP around April 9–10.

The Bihar CM was required to vacate his Legislative Council seat within 14 days because as per Constitutional rules, a person cannot remain a member of both a State Legislature and Parliament simultaneously.

His resignation letter was formally submitted to the Legislative Council Chairman by the State Parliamentary Affairs Minister Vijay Kumar Choudhary and JD-U MLC Sanjay Singh alias Gandhij. The resignation has been accepted and the seat will now be declared vacant. 

However, no official resignation as Chief Minister has been announced yet even as the ruling alliance is considering possible successors. The Vidhan Sabha Speaker Prem Kumar has said Kumar can continue as CM for the next six months.

Along with Nitish Kumar, the BJP national president Nitin Nabin also vacated his seat in the State Assembly, 14 days after being elected as member of the Rajya Sabha.
