AI Content Rules Tightened: Labels & 3-Hour Removal Mandate

From February 20, 2026, all AI-generated photos, videos, and audio musxt carry visible labels; if social media platforms fail to comply with the new IT rules, their legal immunity under the law could be revoked

Feb 11, 2026 - The government has imposed strict rules for online platforms regarding AI-generated fake content, including deepfakes. Platforms like X (formerly Twitter) and Instagram will now be required to remove misleading or fake content within three hours of receiving instructions from a competent authority or a Court.

The government has approved amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which define AI-generated content. The new rules will come into effect from February 20, 2026.

If social media platforms fail to comply with the new IT rules, their legal immunity under the law could be revoked. This means that not only users but also platforms can be held directly accountable for non-compliance.

Key Changes in Rules

Content Removal Deadline: Misleading, fake, or objectionable AI-generated content must be removed within three hours of a government or Court order. Earlier it was 36 hours.

Mandatory Labelling: Every AI-generated photo, video and audio must have a clear and visible label indicating its origin. Earlier it was not mandatory.

Metadata & Watermark: AI content must include permanent metadata or digital identification marks. Earlier it was voluntary.

User Declaration: Users must disclose whether the content they are uploading is AI-generated. Currently this rule is not implemented.
