Court to consider "Attempt to commit Culpable Homicide" charges against Directors of Indira IVF Udaipur

Based on prima facie evidence from the medical reports of the assaulted employee of Indira IVF Udaipur, the Court is considering registering the case under Section 323,325, 506 and 308 of the IPC against Manish Khatri and Ashish Lodha, Directors at Indira IVF, Udaipur.

The high profile Indira IVF altercation episode is going to the next level of charges. Medical reports of the assaulted person Abhishek Sukhwal suggest evidence that injuries to Abhishek are primarily on the upper body and are serious in nature. Injuries above the eyes and on the middle of the head ahve damaged the victims optic nerve, which is a vital part of the body.

Based on prima facie evidence from the medical reports, the Court is assessing the case to be registered under Section 323,325, 506 and 308 of the IPC against Manish Khatri and Ashish Lodha, Directors at Indira IVF, Udaipur. This high profile case of Directors of a company attacking and wounding an employee of Indira IVF came to light after an FIR was filed by Abhishek Sukhwal, an employee of Indira IVF Udaipur against his employers Manish Khatri and Ashish Lodha, both Directors of Indira IVF, on 2 September 2020.

Background of the charges
An FIR was filed earlier this month on behalf of Abhishek Sukhwal, an employee of Indira IVF, against Manish Khatri and Ashish Lodha, Directors at Indira IVF. As per the FIR, the accused Manish and Ashish had been pressurising Abhishek to not support the new management at Indira IVF and resign from the company for the last 3 months. The detailed report mentioned that the when Abhishek refused to listen to Manish and Ashish, they called him to a shop near the centre and assaulted him. After assaulting him, they also warned him of threats to his life and amputate his limbs. As per the FIR they also warned him not to complain to the police.
Dr Ajay Murdia, Chairman of Indira IVF, on coming to know of this episode, had the complaint filed with the police for necessary action. As per the report, when Manish and Ashish came to know of the FIR, they pressurised the Murdia family (Dr Ajay Murdia, Nitij Murdia and Dr Kshitij Murdia) to revoke the complaint. In retaliation, Manish and Ashish filed a FIR against the Murdia family.
As per reports, the police, after investigation, found Manish and Ashish to be guilty of filing a false FIR and after issuing an FR, filed a chargesheet against them in court.

Corporate governance in Indira IVF

Looking into the matter, the Board of Indira IVF, at a board meeting on 5 September, decided to relieve both Directors, Manish Khatri and Ashish Lodha from the role of Director Operations and Director Finance respectively. This was done to ensure that the insecurity and fear among employees is mitigated to a large extent.
