HC orders police to reinvestigate the case of sexual abuse

The Jodhpur High Court has ordered Udaipur Police to re investigate the case of sexual assault lodged by an underage girl against her own grandfather. According to sources, the victim girl, resident of Shobhagpura lodged complaint against her grandfather for sexually abusing her.

 

The Jodhpur High Court has ordered Udaipur Police to re investigate the case of sexual assault lodged by an underage girl against her own grandfather. According to sources, the victim girl, resident of Shobhagpura lodged complaint against her grandfather for sexually abusing her.

Udaipur police arrested the accused and booked him under POSCO (Prevention of Children from Sexual Offence) Act as the victim was minor at the time of incident. The police dismissed the case claiming that the 70-year-old accused is patient of hernia and high blood pressure, is incapable for sexual offence.

As per sources, the victim girl was dissatisfied by the police investigation and appealed in High Court for justice.

The HC considered the plea of victim and ordered re-investigation of the case.

Advocate Suresh Nagori who took up the case to High Court said, ‘Under the POCSO Act, after the victims statement is recorded under the section 164, there are no provisions to let go the accused. Even an immodest word, gesture or vulgar touch is objectionable’.
